WHEREAS, effective November 9, 2015, a Deed of Trust (Security Agreement, Financing Statement and Assignment of Rents) was executed by a representative of VR Ashirwad, LLC, and recorded among the Official Public Records of Bexar County, Texas on November 12, 2015, as Document No. 20150218734 (“Deed of Trust”), in order to secure Ozona Bank in the payment of a U.S. Small Business Administration Note dated November 9, 2015, in the original principal amount of $1,660,200.00 executed by Ramanbhai Patel, Vijyaben Patel and Dilipbhai Patel in their capacities as Manager/Member on behalf of VR Ashirwad, LLC, and individually signed by Ramanbhai Patel and Vijyaben Patel (“Note”); and, WHEREAS, the current owner and holder of the Note is Ozona Bank (“Lender”).” WHEREAS, the undersigned have been appointed Substitute Trustee in the place of the said original Trustee, upon the contingency and in the manner authorized by the Deed of Trust and by law; and WHEREAS, default, as same is defined in the Note and/or the Deed of Trust, has occurred and the outstanding indebtedness on same is now wholly due; and WHEREAS, Lender has requested the undersigned to sell the real property described in the Deed of Trust to satisfy all or a portion of the said indebtedness as defined in the Deed of Trust.
