Antonio Martinez Davila (“Borrower”), executed a Deed of Trust (together with any corrections, changes in terms, renewals, modifications or extensions thereof, collectively, the “2021 Deed of Trust”), conveying to Dan J. Guarino, as Trustee, certain real property hereinafter described and situated in Bexar County, Texas, which Deed of Trust was recorded on October 13, 2021, as Document No. 20210286475 in the Official Public Records of Bexar County, Texas; WHEREAS, the 2021 Deed of Trust was executed to secure Frost Bank, as the Lender (“Lender”), in the payment of “all obligations, debts and liabilities, plus interest thereon, of [Borrower] to Lender . .. whether now existing or hereafter arising, whether obligated as guarantor, surety, accommodation party or otherwise.” WHEREAS, Borrower’s obligations, debts, and liabilities to Lender came to include, and presently continues to include, Borrower’s obligations, debts, and liabilities as the personal guarantor of payment of the Promissory Note dated February 9, 2023, executed by Davila Construction, Inc. in the original principal amount of $2,000,000.00 (together with any corrections, changes in terms, renewals, modifications or extensions thereof, collectively the “Note”); WHEREAS, the 2021 Deed of Trust was amended by the Correction Instrument, dated to be effective as of October 13, 2021, and recorded on October 29, 2024, as Document No. 20240199699 in the Official Public Records of Bexar County, Texas; WHEREAS, on September 30, 2024, Borrower, signing as Antonio “Tony” Davila, executed a Deed of Trust, Security Agreement-Financing Statement, (together with any Doc# 20250900206 08/07/2025 09:07 AM Page 2 of 6 Lucy Adame-Clark, Bexar County Clerk corrections, changes in terms, renewals, modifications or extensions thereof, collectively, the (2024 Deed of Trust”) (together with the 2021 Deed of Trust, the “Deeds of Trust”), conveying to Jimmy R. Locke, as Trustee, certain real property hereinafter described and situated in Bexar County, Texas, to secure Frost Bank, as the Lender, in the payment of the indebtedness evidenced by the Forbearance Agreement executed on September 30, 2024, in the principal amount of $1,999,717.71 (together with any corrections, changes in terms, renewals, modifications or extensions thereof, collectively, the “Forbearance Agreement”). The 2024 Deed of Trust was recorded on October 29, 2024, as Document No. 20240199723 in the Official Public Records of Bexar County, Texas; WHEREAS, in accordance with the Deeds of Trust, Frost Bank, as the current Lender, appointed Sarah Santos and/or Landon Hankins and/or Gabriela Justice of Davis & Santos, PLLC, 719 S. Flores Street, San Antonio, Texas 78204, to act as Substitute Trustee; and WHEREAS, default has occurred under the terms of the Deeds of Trust, and the principal balances of the Note and Forbearance Agreement, plus accrued interest and other fees and costs, and all other indebtedness of Borrower owed to Lender, are now wholly due, and Frost Bank, as Lender, has requested the undersigned to sell the property described in said Deeds of Trust and hereinafter described to satisfy said indebtedness; NOW THEREFORE, notice is given as follows: 1. Property to be sold. Deed of Trust dated October 13, 2021, executed by Tony Davila, a.k.a. Antonio Martinez Davila, recorded on October 13, 2021, as Document No. 20210286475 in the Official Public Records of Bexar County, Texas. b. Deed of Trust, Security Agreement-Financing Statement dated September 30, 2024, executed by Antonio “Tony” Martinez Davila, recorded on October 29, 2024, as Document No. 20240199723 in the Official Public Records of Bexar County, Texas. 3. Date, time, and place of foreclosure sale. The foreclosure sale is scheduled to be held at the following date, time, and place: Date: Tuesday, September 2, 2025. Time: The sale will begin no earlier than 10:00 a.m. or no later than three hours thereafter. The sale will be completed by no later than 4:00 p.m. Place: Outside in between the Bexar County Courthouse, 100 Dolorosa, San Antonio, Texas 78205 and the Paul Elizondo Tower near the intersection of E. Type of sale, The sale is a non-judicial deed-of-trust lien foreclosure sale being conducted pursuant to the power of sale granted by the Deeds of Trust executed by Borrower. The property encumbered by the Deeds of Trust will be sold at the sale in accordance with the provisions of the Deeds of Trust and as permitted by section 9.604(a) of the Texas Business and Commerce Code. 6. Obligations secured. The Deeds of Trust provide that they secure the payment of the indebtedness therein described, including, but not limited to, (a) the Promissory Note in the original principal amount of $2,000,000.00, executed by Davila Construction, Inc., and payable to the order of Frost Bank; (b) all increases, reductions, renewals, extensions, replacements, rearrangements, reinstatements, refinancings, substitutions, alterations, or modifications of all or part of the Note; and among other things, (c) the amounts owed by Borrower to Lender under the terms of the Forbearance Agreement; and (c) all indebtedness, liabilities, and obligations of Borrower, whether actual or contingent, due or to become due and existing or arising from time to time, under or in connection with any agreement between Borrower and Lender. Frost Bank is the current owner and holder of such indebtedness and is the Lender under the Deeds of Trust.
