Texas, together with an undivided interest appurtenant to the units in the
common elements according to the Declaration thereof filed 03/12/2018, recorded in
cc# 201800063138, Real Property Records, Dallas County, Texas, and together with all
amendments thereto together with all improvements thereon, if any, and all rights,
privileges, tenements, hereditaments, rights of way, easements, appendages and
appurtenances, in anyway appertaining thereto, and all right, title and interest of
Grantor in and to any streets, ways, alleys, strips or gores of land adjoining the above described property or any part thereof (hereinafter, the "Property").
(b) All of the following property, items and interests:
(i) Any and all plans and specifications for the rehabilitation, reconstruction or repair
of the Premises; •
(ii) Any and all contracts and subco_ntracts relating to the Premises;
(iii) Any and all permits, licenses, franchises, certificates and other rights and
privileges obtained in connection with the Premises;
(iv) Any and all present and future equipment, fixtures, and articles of personal
property now or hereafter located on the Premises or attached to or used in and
about or related to the planning, development, financing or operation of the
Premises, including, but not limited to, the types of equipment, fixtures, and
articles of personal property more particularly described as follows: machines,
engines, boilers, dynamos, elevators, stokers, tanks, awnings, screens, cabinets,
shades, blinds, carpets, draperies, furniture, lawn mowers and plumbing, heating,
air conditioning, lighting, ventilating, refrigerating, cooking, laundry, and
incinerating equipment, and all such fixtures and appurtenances thereto, and such
other goods and chattels. and personal property as are ever used or furnished in
constructing or operating the Premises or the activities conducted therein, and all
renewals or replacements thereof, or articles in substitution therefor or additions
thereto; •

any public or quasi-public use under any law, or by right of eminent domain, or by
private or other purchase in lieu thereof;
(viii) Any and all leases relating to the property as the same now exists, or is
hereinafter constructed;
(ix) Any and all contracts of sale entered into as to the purchase of the premises or
any of the items described herein.
(c) All other interest of every kind and character.which Granter now h~s or at any time
hereafter acquired in and to the property described or referred ·to in Paragraphs (a)
and b), preceding, and all property which is used or useful in connection with the
Premises, including but not limited to, tradenames, sign inventory and the like,
together with all additions to the property described in these paragraphs (a}, (b} and.
(c}, accessions thereto, and replacements thereof, all of which is sometimes referred
to collectively as the "Property."
All property and interests described or referred to in Paragraphs (a), (b) and ·(c),
preceding, are sometimes hereinafter referred to collectively as the "Property."

$389,939.00; $100,000.00; $4,560.00; and $11,521.69, executed by·

Notice of Foreclosure Sale 2 Time: The sale of the property will be held between the hours of 10:00 a.m. and
4:00 p.m. local time, and the earliest time at which the Foreclosure Sale
will begin is 11:00 a.m. and not later than three hours thereafter.
Place: Dallas County Courthouse in Dallas, Texas, at the following location: THE
PLACE DESIGNATED BY THE COMMISSIONERS COURT OF DALLAS
COUNTY, TEXAS
Terms of Sale: The Foreclosure Sale will be conducted as a public auction and the
Property will be sold to the highest bidder for cash, except that the
Lender's bid may be by credit against the indebtedness secured by the
lien of the Deed of Trust.
Default has occurred in the payment of the Note and in the performance of the
obligations of the Deed of Trust. Because of that default, the Lender, the owner and the holder
of the Note, has requested that the Trustee sell the Property.
The Deed of Trust may encumber both the real and the personal property. Formal
notice is hereby given of the Lender's election to proceed against and sell both the real
property and any personal property described in the Deed of Trust in accordance with the
Lender's rights and remedies under the Deed of Trust and Section 9.604(a) of the Texas
Business and Commerce Code.
There may be and likely are homeowners' association dues and assessments due on the
property that are past due and for which a lien may or may not have been filed. The - homeowners' dues, charges and assessments are believed to be at least $26,599.75.
The amount due on the above referenced Notes is claimed by the Lender to be
$617,737.00 as of July 17, 2025.
Therefore, notice is given that on and at the Date, Time, and Place for the Foreclosure
Sale described above, the Trustee will sell all or part of the Property in accordance
with the Terms of Sale described above, the Deed of Trust and applicable Texas law.
If the Lender passes the Foreclosure Sale, notice of the date of any rescheduled
foreclosure sale will be reposted and refiled in accordance with the posting and filing
requirements of the Deed of Trust and the Texas Property Code.
The Foreclosure Sale will be made expressly subject to any title matters set forth in the
• Deed of Trust, but prospective bidders are reminded that by law the Foreclosure Sale will
necessarily be made subject to all prior matters of record affecting the Property, if any, to the
extent that they remain in force and effect and have not been subordinated to the Deed of
Trust. For the avoidance of doubt, the Foreclosure Sale will not cover any part of the Property
that has been released of public record from the lien and/or security interest of the Deed of

Trust by the Lender. Prospective bidders are strongly urged to examine the applicable property
records to determine the nature and extent of such matters, if any.
Pursuant to Section 51.009 of the Texas Property Code, the Property will be sold "AS
IS", without any expressed or implied warranties, except as to the warranties (if any)
provided for under the Deed of Trust. Prospective bidders are advised to conduct an
independent investigation of the nature and physical condition of the Property as well as any
unpaid property taxes and/or other liens.
Pursuant to Section 51.0075(a) of the Texas Property Code, the Trustee
reserves the right to set furtheueasonable conditions for conducting the Foreclosure Sale. Any
such further conditions shall be announced before bidding is opened for the first sale of the day
held by the Trustee.
