ArticleX, Section10.8oftheDeclaration furtherprovidesthattheAssociation
mayforeclose itsassessment lienbyappropriate judicial ornonjudicial
proceedings.

DuringtheperiodofRespondents' ownership, Respondents havebeenassessed

ownership oftheProperty.
8.
ArticleX, Section10.1oftheDeclaration andTexasPropertyCode5.006provide

delinquent assessments.

AsofOctober 24,
2024,
Respondents are22months indefault inhis/her
obligations totheAssociation foratotalofThreeThousand FiveHundred and
Sixteen Dollars andEightyCents($ 3,516.80).

Respondents havebeennotified oftheamounts dueandunpaidattributed to
Respondents' failuretopaytheassessments andotherchargesbynoticeletter
datedOctober 2,2023.

ANotice ofLienwasfiledonoraboutNovember 17, 2023atInstrument No.
2023000132393 intheofficeoftheCountyClerkofCOLLIN, Texas, and
Respondents werenotifiedofsamebyletterdatedNovember 16,2023.

TheAssociation afforded Respondents thirty

daystocurethedefault
pursuanttotheNovember 16,2023letter,andsuchopportunity tocurethedefault
hasexpired.
13.
PriortofilingthisApplication, theAssociation performed allactionsrequired
underapplicable lawandthetermsoftheDeclaration requiredpriortoforeclosing
theAssociation' sassessment lienagainsttheProperty.
THECOURT THEREFORE GRANTS theAssociation' sApplication forForeclosure
