Article IV, Section 4.13(a) oftheDeclaration creates anassessment lienagainst theProperty tosecurepayment ofassessments andotherchargespursuant toTex. R. Civ. Proc. 735.1(c) andTex. Prop. Code209.0092. 6.

Section 4.13(b)
oftheDeclaration furtherprovides thatthe Association mayforeclose itsassessment lienbyappropriate judicialornon- ORDER FORFORECLOSURE UNDER TEX.R.CIV.PROC. 736 PAGE 2judicialproceedings. 7.

DuringtheperiodofRespondent' sownership, Respondent hasbeenassessed maintenance feesinanon-discriminatory manner basedonRespondent' s ownership oftheProperty. 8.

ArticleIV, Section4.13(a) oftheDeclaration andTexasProperty Code5.006 provideforrecoveryofattorney'sfeesandexpensesincurredinthecollection of delinquent assessments. 9.

AsofDecember 10,
2024,
Respondent was7months indefault intheir obligations totheAssociation foratotalofTwoThousand ThreeHundred and ThirtySeven Dollars andEighty SixCents($ 2,337.86). 10.

Respondent hasbeennotified oftheamounts dueandunpaid attributed to Respondent' sfailuretopaytheassessments andotherchargesbynoticeletter datedApril24,2024. 11.

ANotice ofLienwasfiledonoraboutJune11, 2024at2024000070428 inthe officeoftheCountyClerkofCollinCounty, Texas, andRespondent wasnotified ofsamebyletterdatedJune11,2024. 12.

TheAssociation affordedRespondent thirty(30) daystocurethedefaultpursuant totheJune11, 2024letter, andsuchopportunity tocurethedefaulthasexpired. 13.

PriortofilingthisApplication, theAssociation performed allactionsrequired underapplicable lawandthetermsoftheDeclaration requiredpriortoforeclosing theAssociation' sassessment lienagainsttheProperty. THECOURT THEREFORE GRANTS theAssociation' sApplication forForeclosure underTex. R. Civ. Proc. 736.
