DuringtheperiodofRespondents' ownership, Respondents havebeenassessed maintenance feesinanon-discriminatory mannerbasedonRespondents' ORDER FORFORECLOSURE UNDER TEX.R.CIV.PROC. 736 PAGE 2ownership oftheProperty. 8.

Article7, Section 7.6andArticle 8, Section 8.3oftheDeclaration andTexas PropertyCode5.006provideforrecoveryofattorney'sfeesandexpensesincurred inthecollection ofdelinquent assessments. 9.

AsofMay5, 2025, Respondents were47monthsindefaultintheirobligations to theAssociation foratotalofEightThousandandThirtyFourDollarsandForty TwoCents($ 8,034.42). 10.

Respondents havebeennotified oftheamounts dueandunpaidattributed to Respondents' failuretopaytheassessments andotherchargesbynoticeletter datedJune30, 2022. 11.

ANotice ofLien wasfiled onoraboutOctober 11, 2022, atDocument No. 2022000151457 inthe office oftheCounty ClerkofCollin,
Texas,
and Respondents werenotifiedofsamebyletterdatedOctober11,2022. 12.

TheAssociation afforded Respondents thirty ( 30)
daystocurethedefault pursuanttotheOctober11, 2022, letter, andsuchopportunity tocurethedefault hasexpired. 13.

PriortofilingthisApplication, theAssociation performed allactionsrequired underapplicable lawandthetermsoftheDeclaration requiredpriortoforeclosing theAssociation' sassessment lienagainsttheProperty.
