ByvirtueofRespondents' acquisition oftheProperty, Respondents agreedtoand becameobligated bytheDeclaration topaytotheAssociation allassessments for theexpenseofadministration, maintenance, upkeepandrepairoftheCommunity asassessedinaccordance withtheDeclaration, asmoreparticularly shownin ArticleVIIoftheDeclaration. 5.

ArticleVII, Section 7.08(a) oftheDeclaration createsanassessment lienagainst thePropertytosecurepaymentofassessments andotherchargespursuanttoTex. R. Civ. Proc. 735.1(c)andTex. Prop. Code209.0092. 6.

Article VII,
Section 7.08(b)
oftheDeclaration furtherprovides thatthe Association mayforecloseitsassessment lienbyappropriate judicialornon- judicialproceedings. 7.

DuringtheperiodofRespondents' ownership, Respondents havebeenassessed ORDER FORFORECLOSURE UNDER TEX.R.CIV.PROC. 736 PAGE 2maintenance feesinanon-discriminatory mannerbasedonRespondents' ownership oftheProperty. 8.

Article VII, Section 7.01andSection 7.08(b) oftheDeclaration andTexas PropertyCode5.006provideforrecoveryofattorney'sfeesandexpensesincurred inthecollection ofdelinquent assessments. 9.

AsofAugust 21,

Respondents were48months indefault intheir obligations totheAssociation foratotalofFourThousand OneHundred and Eighty ThreeDollars andSixtyCents($ 4,183.60). 10.

Respondents havebeennotified oftheamounts dueandunpaid attributed to Respondents' failuretopaytheassessments andotherchargesbynoticeletter datedFebruary 17,2022. 11.
