ByvirtueofRespondents' acquisition oftheProperty, Respondents agreedtoand becameobligatedbytheDeclaration topaytotheAssociation allassessments for theexpenseofadministration, maintenance, upkeepandrepairoftheCommunity asassessedinaccordance withtheDeclaration, asmoreparticularly shownin ArticleX, Section10.1oftheDeclaration. 5.

ArticleX, Section10.8oftheDeclaration createsanassessment lienagainstthe Propertytosecurepaymentofassessments andotherchargespursuanttoTex. R. Civ.Proc. 735.1(c)andTex. Prop. Code209.0092. 6.

ArticleX, Section10.8oftheDeclaration furtherprovidesthattheAssociation mayforecloseitsassessment lienbyappropriate judicialornonjudicial proceedings. 7.

DuringtheperiodofRespondents' ownership, Respondents havebeenassessed ORDER FORFORECLOSURE UNDER TEX.R.CIV.PROC. 736 PAGE 2maintenance feesinanon-discriminatory mannerbasedonRespondents' ownership oftheProperty. 8.

ArticleX, Section10.1oftheDeclaration andTexasPropertyCode5.006provide forrecoveryofattorney'sfeesandexpenses incurredinthecollection of delinquent assessments. 9.

AsofNovember 20, 2024, Respondents are23monthsindefaultinhisthcr obligations totheAssociation foratotalofTenThousand FourHundred and SixtyThreeDollars andTwentyThreeCents($ 10,463.23). 10.

Respondents havebeennotifiedoftheamounts dueandunpaidattributed to Respondents' failuretopaytheassessments andotherchargesbynoticeletter datedFebruary16,2023. 11.

ANoticeofLienwasfiledonoraboutApril12, 2023atInstrument No. 2023000038475 intheofficeoftheCountyClerkofCOLLIN, Texas,
and Respondents werenotifiedofsamebyletterdatedApril10, 2023. 12.

TheAssociation afforded Respondents thirty ( 30)
daystocurethedefault pursuanttotheApril10, 2023letter, andsuchopportunity tocurethedefaulthas expired. 13.

PriortofilingthisApplication, theAssociation performed allactionsrequired underapplicable lawandthetermsoftheDeclaration requiredpriortoforeclosing theAssociation' sassessment lienagainsttheProperty. THECOURT THEREFORE GRANTS theAssociation' sApplication forForeclosure underTex.R.Civ. Proc. 736.
