ByvirtueofRespondent' sacquisition oftheProperty, Respondent agreedtoand becameobligated bytheDeclaration topaytotheAssociation allassessments for theexpenseofadministration, maintenance, upkeepandrepairoftheCommunity asassessedinaccordance withtheDeclaration, asmoreparticularly shownin Article IVoftheDeclaration. 5.

Article IV, Section 4.01oftheDeclaration creates anassessment lienagainst the Propertytosecurepaymentofassessments andotherchargespursuanttoTex. R. Civ. Proc. 735.1(c)andTex. Prop. Code209.0092. 6.

ArticleIV, Section4.08oftheDeclaration furtherprovides thattheAssociation mayforeclose itsassessment lienbyappropriate judicialornonjudicial proceedings. 7.

DuringtheperiodofRespondent' sownership, Respondent hasbeenassessed maintenance feesinanon-discriminatory manner basedonRespondent' s ownership oftheProperty. 8.

Section4.08oftheDeclaration andTexasProperty Code5.006 ORDER FORFORECLOSURE UNDER TEX.R.CIV.PROC. 736 PAGE 2provideforrecoveryofattorney'sfeesandexpensesincurredinthecollection of delinquent assessments. 9.

AsofMarch 11, 2025, Respondent was25months indefault initsobligations to theAssociation foratotalofSixThousand FiveHundred andSeventy Two Dollars andTwoCents($ 6,572.02). 10.

Respondent hasbeennotified oftheamounts dueandunpaid attributed to Respondent' sfailuretopaytheassessments andotherchargesbynoticeletter datedJune12,2024. 11.

ANotice ofLienwasfiledonoraboutAugust 6, 2024atInstrument No. 2024000095836 intheofficeoftheCountyClerkofCollinCounty, Texas, and Respondent wasnotifiedofsamebyletterdatedAugust5, 2024. 12.

TheAssociation afforded Respondent thirty (30) daystocurethedefaultpursuant totheAugust5,2024letter,andsuchopportunity tocurethedefaulthasexpired. 13.

PriortofilingthisApplication, theAssociation performed allactionsrequired underapplicable lawandthetermsoftheDeclaration requiredpriortoforeclosing theAssociation' sassessment lienagainsttheProperty. THECOURT THEREFORE GRANTS theAssociation' sApplication forForeclosure underTex. R. Civ. Proc. 736.
