WHEREAS, by that certain Deed of Trust with Balloon Rider (the "Deed of Trust"), dated
November 19, 2025, executed and delivered by TRACY TRAN ("Grantor"), to Michael B. Massey,
Trustee, filed for record on November 20, 2025 under County Clerk's File No. 2025120187 in the
Official Public Records of Fort Bend County, Texas, Grantor conveyed to the Trustee certain
property situated in Fort Bend County, Texas, more particularly described in Exhibit A attached
hereto and made a part hereof for all purposes (hereinafter referred to as the "Property"), to secure
the payment of that one certain Promissory Note (the "Note"), dated November 19, 2025, in the
original principal amount of $185,000.00, executed by Grantor and payable to the order of PND
Holdings, LLC, a Texas limited liability company ("Lender"), and any and all other indebtedness
secured by and described in the Deed of Trust; and
WHEREAS, the indebtedness evidenced by the Note and secured by the Deed of Trust is in
default and the entire unpaid balance thereof is now due and payable, and Lender has demanded
payment of the Note and intends to have the power of sale set forth in the Deed of Trust enforced;
and
WHEREAS, Lender has by instrument executed and acknowledged in writing appointed
Sandy Dasigenis, Jeff Leva, Steve Leva, Amar Sood, Patricia Poston or Michael B. Massey, as
Substitute Trustee under the Deed of Trust; and
WHEREAS, Lender has-directed the Substitute Trustee to enforce the power of sale under
the Deed of Trust for the purpose of collecting the indebtedness set forth therein after giving notice
of the time, place and terms of said sale, and the property to be sold, pursuant to the Deed of Trust
and the laws of the State of Texas.

NOW, THEREFORE,,notice is hereby given that on Tuesday, January 6, 2026, same being
the first Tuesday in said month, between the hours of 1 :00 o'clock p.m. and 4:00 o'clock p.m., the
undersigned Substitute Trustee, after having complied with the terms of sale set forth in the Deed
of Trust and the laws of the State of Texas, will sell the Property at public auction to the highest
bidder or bidders, for cash, at the Fort Bend County Gus George Academy-Patton Hall, 1521 Eugene Heimann Circle, Richmond, Texas 77469, or as DESIGNATED BY THE COUNTY
COMMISSIONER'S OFFICE. The earliest time at which the sale shall begin is 1:00 o'clock p.m.
The conveyance of the Property shall be made subject to any exceptions referenced in the
Deed of Trust to the extent that the same are still in effect.
EXCEPT FOR AW ARRANTY OF TITLE GIVEN ON BEHALF OF GRANTOR, THE SALE OF THE
PROPERTY IS "AS IS" AND "WHERE IS" AND WITHOUT REPRESENTATION OR WARRANTY OF
ANY KIND BY THE SUBSTITUTE TRUSTEE, EXPRESS, IMPLIED, STATUTORY, QUASI-STATUTORY OR
OTHERWISE, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
BEING EXPRESSLY DISCLAIMED, NEITHER THE LENDER NOR THE SUBSTITUTE TRUSTEE MAKES
ANY REPRESENTATIONS OR WARRANTIES WITH RESPECT TO COMPLIANCE WITH LAWS, RULES,
AGREEMENTS OR SPECIFICATIONS, NOR WITH RESPECT TO CONDITION, QUALITY, CAPAO1Y,
DESIGN, OPERATION, ABSENCE OF ANY LATENT DEFECTS OR ANY OTHER WARRANTY OR
REPRESENTATION WHATSOEVER WITH RESPECT TO THE PROPERTY, ALL OF WHICH SHALL BE
EXPRESSLY WAIVED BY THE PURCHASER.
